Privacy notice

From the enquiry form on this website: your name, your company name, the phone number and email address you put in the phone and email field, and what you write about the equipment or the service you need. The form also sends the address of the page you were on, so we can see what your enquiry is about before we read it.

From WhatsApp, email and telephone: whatever you choose to tell us, which is usually the same information.

From your visit to the website: the pages you open and roughly where in the world you are, in the form of website statistics. That part is described under cookies below.

What you send us through the form, on WhatsApp, by email or on the phone comes from you. The visit statistics described below are the one thing that does not reach us that way: they are recorded while you use the site.

To answer your enquiry, to prepare a quote, and to carry out the work if you place an order. That is the whole purpose. The legal ground is section 6(2)(b) of the Act: we process your details because you asked us for a quote, and a quote can lead to a contract.

If you ask us to keep you informed about anything else, we treat that as a separate choice and ask for your consent separately.

Two fields carry an asterisk: your name, and the phone and email field. We need both before we can send you an answer. Your company name and the description of what you need are optional, although a quote gets more accurate the more you tell us.

If you name a colleague or someone else in the description, please give only what we need in order to answer you. We use those details for the same enquiry and nothing else, and anyone named can ask us to remove them using the contact details below.

We share your details with these kinds of parties, and only if the work requires it:

• The company that hosts this website and our email.
• Google, which provides the website statistics described below.
• A manufacturer or a service centre, if your enquiry concerns their product and the answer has to come from them.
• A regulator or an authority, if the law requires us to hand something over.

Your details are used for answering you and serving you, and for nothing else. They stay with us, and they go on no list that anyone else uses for marketing.

Google processes the website statistics outside Malaysia. Data about your visit therefore leaves the country, and that transfer rests on section 129(3)(f) of the Act: we take all reasonable precautions and exercise all due diligence to make sure your details are not handled abroad in a way that would break this Act if it happened in Malaysia. We keep a list of the parties involved, the country and the purpose, and you can ask us for it using the contact details below.

This website uses Google Analytics to count visits and to see which pages are read. It places two cookies in your browser, records the pages you open and the type of device you use, and works out an approximate location from your IP address. We use the totals to see which parts of the site are useful, and they play no part in a quote or an order. The statistics are kept for fourteen months.

Malaysian law does not make us ask your permission for cookies, so this site puts no banner in front of you. Every browser lets you refuse or delete cookies, usually under settings and then privacy, and the site works without them.

We keep enquiries and the correspondence around them for up to three years after our last contact with you, and once a year we clear out what is older than that. If an enquiry became an order, the records that Malaysian tax and company law require us to keep are held for the period those laws set.

The website runs over an encrypted connection. Enquiries arrive in one mailbox, crm@topborneo.com, and access to it is limited to the people who handle quotes and orders. We stay responsible for protecting your details, including when a hosting or email provider handles them on our behalf, and we pick those providers with that in mind.

If you are not satisfied with how we handle your request, section 104 of the Act lets you complain in writing to the Personal Data Protection Commissioner of Malaysia.

When this notice changes, the new version appears on this page with a new revision date at the top. If a change is significant, we say so on the page.

This notice exists in English and in Bahasa Malaysia, as section 7(3) of the Act requires, and we keep the two the same. The Malay version is at Notis privasi.
